A tow truck driver is being charged with manslaughter after a man who’s truck was being towed jumped onto the moving vehicle and was run over, police say.

James Smith was found lying in a parking lot at around 3:20 a.m. when officers were dispatched to the 10000 block of Shoreview Road near Thurgood Lane. Roberto Padilla, the 25-year-old tow truck driver, was booked into the county jail and is facing a charge of manslaughter in connection to the death of Smith, according to The Dallas Morning News.

According to Dallas police, Smith leaped onto the driver’s side of his car, which was being towed from the lot, and was run over. He was taken to a local hospital where he died from his injuries, police say.

Padilla has not been entered into the Dallas County Jail database as of 2:30 p.m. on Dec. 4.
